Trademark Research

For each category of trade, and for each state or country of registration, it is necessary to search published records for prior commercial use of each trademark or service mark, so as to avoid possible trademark infringement.

Geissler & Associates offers legal research in English-language publications and public records for possible prior trademark infringement in each jurisdiction where trademark registration is sought.

Trademark Registration

Geissler & Associates routinely files English-language International Trademark Registration Applications at the World Intellectual Property Organization (WIPO) in Geneva, Switzerland, using the Madrid Agreement and Protocol.

Trademark Fees

Following the Madrid Agreement and Protocol, separate fees are levied for each trade category and for each country where registration is sought. Typically, however, costs per trademark or service mark, are as follows, inclusive of research, WIPO and national filing fees, and professional fees.

Slightly higher fees are charged for International Trademark Registration pursuant to the Trademark Law Treaty Regulations (Geneva, October 1994) and the Singapore Treaty on the Law of Trademarks (March 2006).

Professional Fees

Geissler & Associates charges $240 per hour for all work associated with International Trademark Registration Applications at the World Intellectual Property Organization in Geneva, Switzerland, and during national phase of trademark prosecution. As needed, and as required by local law and custom, Geissler & Associates sub-contracts with local legal counsel to facilitate the national phase of trademark prosecution.

In the United States of America, Mr. David Allen, General Counsel for Geissler & Associates, reviews and approves all trademark research, opinions regarding possible infringement, and trademark applications submitted for and on behalf of our clients to the U.S. Patent and Trademark Office in Washington D.C.  The cost of these legal services is included in the cost list, above.
